In October 2021, the ABCC commenced court proceedings alleging that James Darnton-Turner and Brian Windsor, and through them the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing And Allied Services Union (CEPU), breached section 500 of the Fair Work Act while the two officials were exercising entry rights as permit holders at the Founders Lane project site in Canberra. In December 2022, these proceedings were transferred from the ABCC to the Fair Work Ombudsman. On 9 March 2023, the Fair Work Ombudsman discontinued these proceedings.
