In November 2021, the ABCC commenced court proceedings alleging that Bradley Upton and Stephen Parker, and through them the Construction, Forestry, Maritime, Mining and Energy Union (CFMMEU), engaged in an unlawful picket, and that the union also organised the unlawful picket, at a company’s construction yard in Balcatta, Perth in breach of section 47 of the Building and Construction Industry (Improving Productivity) Act. In December 2022, these proceedings were transferred from the ABCC to the Fair Work Ombudsman. On 28 March 2023, the Fair Work Ombudsman discontinued these proceedings.
