In March 2022, the ABCC commenced court proceedings alleging that Jason Bushnell, and through him the Construction, Forestry, Maritime, Mining and Energy Union (CFMMEU), breached sections 346, 348 and 349 of the Fair Work Act at the Brisbane South State Secondary College project in May 2021. In December 2022, these proceedings were transferred from the ABCC to the Fair Work Ombudsman. On 18 September 2023, the Fair Work Ombudsman discontinued these proceedings.
