In April 2022, the ABCC commenced court proceedings alleging that the Construction, Forestry, Maritime, Mining and Energy Union (CFMMEU) and its delegate Michael Powell breached section 78 of the (now repealed) Building and Construction Industry (Improved Productivity) Act 2016 by Mr Powell intentionally hindering or obstructing two ABCC inspectors at an Australian Catholic University building site in Fitzroy (Melbourne) on 5 May 2021. In December 2022, these proceedings were transferred from the ABCC to the Fair Work Ombudsman. In November 2023, the Fair Work Ombudsman discontinued these proceedings.
