In September 2022, the ABCC commenced court proceedings alleging a breach of section 500 of the Fair Work Act by CEPU official Wendel Moloney and the CEPU, and CFMMEU official Matthew Vonhoff and the CFMMEU, for improper conduct at the 443 Queen Street, Brisbane residential tower project site. In December 2022, these proceedings were transferred from the ABCC to the Fair Work Ombudsman. On 16 May 2023, the Fair Work Ombudsman discontinued the proceedings against Mr Vonhoff and the CFMMEU only.
