Overtime for casuals in the Nurses Award
We are currently reviewing this article in relation to whether overtime entitlements apply for an employee not having days free from duty and the exclusion of overtime for certain job classifications.
We encourage you to check back regularly for updates.
Casuals get overtime if they work more than:
- 38 hours in a week, 76 hours in a fortnight or 152 hours over 28 days
- 10 hours in a shift or day.
Casuals don't get overtime for working outside the span of ordinary hours.
Overtime is calculated on an employee’s casual hourly rate. The casual hourly rate is the minimum hourly rate plus the casual loading.
Australian Nursing and Midwifery Federation v Domain Aged Care (Qld) Pty Ltd T/A Opal Aged Care considered the calculation of overtime rates for casuals in the Nurses Award.
