Overtime for casuals in the Nursery Award
Casuals get paid overtime when they work:
- more than:
- an average of 38 hours per week but not more than 152 hours in 28 days, or
- the hours required to be worked by the employer, whichever is less
- outside the span of ordinary hours
- more than 8 hours a day (or up to 10 by agreement).
What’s the span of ordinary hours?
- 6am to 6pm on 5 out of any 7 days in a week
- 6am to 9pm on 1 day a week between Monday and Friday.
Example
Sally is a casual sales assistant. She works 9am to 5pm on Monday, Tuesday, Wednesday and Friday. On Thursday she works 12pm to 8pm.
Sally doesn’t get paid overtime for working past 6pm on Thursday. This is because her employer can roster her to work ordinary hours until 9pm on 1 day between Monday and Friday each week.
