Child employment in NSW & the Fair Work System
There’s legislation (law) in NSW that has rules about employing young people.
This law doesn't apply to employees in the Fair Work System in relation to conditions that are also contained in:
- the National Employment Standards
- a modern award
- a registered agreement.
Unfair dismissal terms in the NSW law don’t apply either. The unfair dismissal terms in the Fair Work Act 2009 apply instead.
When does the child employment legislation in NSW apply to Fair Work System employees?
It applies to employees in the Fair Work System in relation to:
- maximum periods of work
- minimum rest breaks
- restrictions on working after a certain time of day.
