Sick leave during annual leave

If an employee is sick or injured while on annual leave, the employee can use their paid sick leave instead of their annual leave.

The amount of sick leave taken is deducted from the employee's sick and carer's leave balance, and their annual leave balance is recredited.

The employee will need to give their employer notice that they're taking sick leave, and provide evidence if their employer asks for it. See Notice & medical certificates for more information.

What if the employee doesn’t have enough sick leave?

The employee can continue with the annual leave or take unpaid leave.

Example

Georgia went on 2 week’s annual leave. She got sick at the start of the second week.

Georgia had 3 days paid sick leave available. She took sick leave for 3 days and annual leave for the remaining 2 days.

If she didn’t want to use her annual leave for the remaining 2 days, she could take unpaid sick leave.
