Award coverage for motel live-in managers
A motel live-in manager is responsible for managing the day-to-day running of the motel and its staff and services, whilst living on-site. Their duties may also include other tasks such as sales, cleaning and administrative work, as required.
A motel live-in manager isn’t covered by the Hospitality Award, even though this Award covers employers who operate a motel. This is because there is no classification in the Hospitality Award for motel live-in managers.
Depending on their duties and qualifications, a motel live-in manager will either be:
- covered by the Miscellaneous Award, or
- award free.
Miscellaneous Award
The Miscellaneous Award doesn’t cover managerial employees or professional employees.
Whether a particular motel live-in manager is covered by the Miscellaneous Award will depend on the specific duties and qualification requirements of the role.
For example, a motel live-in manager is more likely to be covered by the Miscellaneous Award if there are no qualification requirements for their role.
Employees may wish to seek independent advice on their own situation.
Award free
An employee who is not covered by the Miscellaneous Award is award free.
For example, a motel live-in manager who is required to hold a relevant qualification is more likely to be award free.
They’re entitled to the national minimum wage and the National Employment Standards.
Fair Work Ombudsman v NSW Motel Management Services Pty Ltd & Ors (No 2) [2018] FCCA 1935 - confirmed that motel live-in managers aren’t covered by the Hospitality Award.
